Reality: Texas courts prioritize the child’s best interests, and gender does not factor into that decision. Custody decisions consider each parent’s ability to provide financial stability, emotional support, and a nurturing environment.
Myth 2: Women Always Receive Spousal Support
Reality: Spousal support is determined by financial need, income, and circumstances — and long-term is not common in Texas. Spousal support often is awarded temporarily during the pendency of the divorce until it is final. Prolonged spousal support is more rare and is dependent on meeting criteria, such as the proven inability to work, such as due to a disability or caring for a child with a disability.
Myth 3: Women Will Lose Financial Security in Divorce
Reality: Texas community property laws ensure a fair division of assets. Prenuptial and postnuptial agreements may also provide additional protection for your assets. That being said, both spouses should prepare to work toward financial independence after the divorce.
