Basic “guideline child support in Texas uses a percentage-based model to calculate child support.  The calculation applies a percentage based on the number of children to be supported as well as the “net income” of the parent paying child support.  However, many Frisco parents recognize that the needs of their children exceed the “guideline child support” calculation, and will negotiate payment for the additional needs of their children, such as:

  • Private school tuition and/or homeschool expenses.
  • Supplemental educational expenses, such as tutors, college prep advising, enrichment programs, AP testing, dual-credit college classes.
  • Extracurricular activities, such as select team sports (e.g., soccer, football, baseball), marching band, competitive dance and cheerleading, gymnastics.
  • Shared child-care needs (e.g., nanny, au Paire).
  • Transportation related expenses.

Spousal maintenance in a Frisco divorce is challenging because Texas law requires that a spouse prove they don’t have sufficient resources to pay for their minimum reasonable needs and that they cannot earn a sufficient income.  It is more likely that spousal maintenance may be awarded if that spouse is unable to work due to a physical or mental disability, or because the spouse is caring for a child with a physical or mental disability.  While spousal maintenance post-divorce is rare in Texas, temporary spousal maintenance is more common while the divorce is pending and when the community property estate has not yet been divided.

Common Questions About Divorce in Frisco

How long does divorce take in Frisco?

While the legal minimum waiting period is 60 days, most cases take 6 to 9 months from filing to settlement, depending on complexity and level of conflict.

Do I have to go to court?

Not always. Most divorces are resolved through collaborative law or mediation, offering a more peaceful, private path.

How is property divided?

Texas is a community property state, which means that the community property assets will be divided in a manner that is “just and right.” The process begins with identifying all the assets of the parties, characterizing those assets as separate property or community property, and then valuing those assets.  In a Frisco divorce, it’s common for the parties to need a valuation expert for the business, real estate, collections, and other assets. Then through negotiation or mediation, the assets are divided in an equitable way that reflects the needs of your unique family.

Can I move with my child?

It’s important to know that Denton County and Collin County courts both have standing orders that restrict parties from moving once a case has been filed while the divorce is pending.  Also, judges favor keeping parents near their children, and they often will impose a geographic restriction that, at a minimum, restricts the residence of the child to the current county and surrounding counties.  If you are contemplating a move outside of Frisco, it is important to discuss this with your attorney to explore opportunities for negotiating an alternative to the standard geographic restriction.  Note that while parties can craft solutions themselves, if you do have to go to court, the court will always evaluate what’s in your child’s best interest and make the decision accordingly.

If you are seeking to move or modify an existing court order, you will need to pay close attention to the language of the original order.  Relocating due to a job change, second marriage, or family support are the most common reasons why parents file to modify their original order.

What if my ex isn’t following the order?

Violations of existing orders can be enforced through the court. Penalties may include fines, custody changes, or other legal consequences. Failure to pay child support in Texas is addressed through the Office of the Attorney General and can result in wage garnishments and even jail. Other enforcements are challenging, and a skilled family law attorney is needed to help you make a strong case and advocate in court to enforce a current order.
